Importer & Distributor of Harlem Kitesurfing products in Australia.
1. Overview
Stormforce Kite Co Pty Ltd (“Stormforce“, “we”, “us”, or “our”) is committed to providing high-quality products and service. This Refunds & Returns Policy outlines your rights and our obligations under the Australian Consumer Law (ACL), as well as our additional policies regarding change of mind returns.
This policy applies to all Harlem Kitesurfing products supplied by Stormforce Kite Co Pty Ltd within Australia, whether purchased directly from us or through an authorised retailer.
2. Australian Consumer Law
Nothing in this policy limits or excludes your rights under the Australian Consumer Law. Under the ACL, you are entitled to a repair, replacement, or refund if a product:
- Has a major failure
- Is not of acceptable quality
- Is not fit for its intended purpose
- Does not match its description or sample
A major failure includes situations where:
- The product is unsafe
- A reasonable consumer would not have purchased the product had they known about the issue
- The product is significantly different from the description or sample
For major failures, you may choose a refund or replacement. For minor failures, we may choose to repair or replace the product within a reasonable time.
3. Warranty & Manufacturing Defects
Harlem Kitesurfing products supplied by Stormforce Kite Co Pty Ltd are covered by the Harlem Kitesurfing International Manufacturer’s Warranty.
Warranty Period
- Harlem kites, control systems, boards and related products are covered by a two (2) year warranty from the original date of purchase against defects in materials and workmanship.
- Customers may be eligible for an additional 180-day extended warranty if the product is registered directly with Harlem Kitesurfing within 60 days of purchase, subject to Harlem’s terms and conditions.
What the Warranty Covers
The warranty covers manufacturing defects only, being faults in materials or workmanship identified under normal and intended use.
What the Warranty Does Not Cover
The warranty does not cover:
- Normal wear and tear
- Damage caused by misuse, neglect, incorrect setup, or improper maintenance
- Damage caused by crashing, impact, abrasion, or contact with sharp objects
- UV damage, sun exposure, or improper storage
- Damage caused by excessive wind or weather conditions
- Products used for commercial, rental, teaching or instructional purposes
- Modifications, alterations, or repairs carried out by unauthorised persons
All warranty claims are assessed by Stormforce Kite Co Pty Ltd in conjunction with Harlem Kitesurfing.
4. Returns Process for Faulty Products
If you believe your product is faulty, please contact Stormforce Kite Co Pty Ltd as soon as possible with:
- Proof of purchase
- A detailed description of the issue
- Clear photos and/or videos showing the fault
Products must not be returned without prior approval. Once assessed, we will advise whether the item should be returned for inspection.
If a manufacturing defect is confirmed, the remedy (repair, replacement, or refund) will be provided in accordance with the Australian Consumer Law and at the discretion of Stormforce Kite Co Pty Ltd and/or Harlem Kitesurfing.
Where a warranty claim is approved:
- Reasonable return shipping costs will be covered by Stormforce Kite Co Pty Ltd
- Any replacement or repair will be subject to product availability
5. Change of Mind Returns
We do not offer refunds or exchanges for change of mind.
This includes:
- Incorrect size or model selection
- Preference changes after purchase
- Items purchased for a specific event or trip
Please choose carefully before purchasing. Our team and authorised dealers are available to assist with product selection prior to purchase.
6. Conditions for Approved Returns
Where a return is approved, items must:
- Be unused and in original condition
- Include all original packaging, accessories, and documentation
- Be free from damage, wear, sand, salt, or water exposure
We reserve the right to refuse returns that do not meet these conditions.
7. Sale & Clearance Items
Sale, clearance, and discounted items are subject to the same rights under the Australian Consumer Law.
However, we do not offer refunds or exchanges for change of mind on sale or clearance items.
8. Proof of Purchase & Authorised Retailers
All refund or warranty claims must be accompanied by valid proof of purchase.
The Harlem Kitesurfing international warranty applies only to products purchased from:
- Stormforce Kite Co Pty Ltd, or
- An authorised Harlem Kitesurfing retailer or dealer in Australia.
Products purchased from unauthorised sellers or overseas retailers may not be eligible for warranty support in Australia.
